Welcome to Xcel Learning. Xcel Learning is a trading name of Fabian Sealey, a sole trader based in Guyana (“Xcel Learning”, “we”, “us” or “our”). By accessing or using our website and services, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our platform.
1. Use of the Platform
Xcel Learning provides online educational content through a learning management system. Users must create an account to access courses.
You agree to:
- Provide accurate account information
- Keep your login credentials secure
- Use the platform for lawful purposes only
2. Eligibility
Our services are available to users of all ages. Users under 18 should have parental or guardian permission to use the platform, particularly for paid services.
3. Course Access & Content
- Course access is granted after successful enrollment or payment
- Course materials are for personal educational use only
- Sharing, reselling, or redistributing content is prohibited
All content remains the intellectual property of Xcel Learning unless otherwise stated.
4. Payments & Refunds
We offer two ways to pay:
- Online card and other payments through Paddle. Our online order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for these orders. Paddle processes the payment, handles billing and invoicing, provides customer service for these purchases and handles returns. These purchases are also subject to Paddle’s Buyer Terms and Conditions and Refund Policy.
- MMG (Mobile Money Guyana). Payments made by MMG are received directly by Fabian Sealey, trading as Xcel Learning, and are not processed by Paddle. We handle billing, customer service and refunds for MMG purchases ourselves.
14-day refund right: Whichever way you pay, you have the right to request a full refund within 14 days of your purchase, without giving any reason. This applies to all digital purchases, including course enrollments and subscriptions.
To request a refund:
- Paddle purchases: contact Paddle directly through paddle.net using the details in your order confirmation email, or email us at admin@xcellearning.com and we will help you process your request through Paddle
- MMG purchases: email us at admin@xcellearning.com with your name, the course purchased and your MMG transaction ID, and we will refund you to your MMG account
Approved refunds are returned to your original payment method. Once a refund is issued, access to the related course or content will be removed.
5. User Conduct
You agree not to:
- Misuse the platform
- Attempt unauthorized access
- Upload harmful or illegal content
- Disrupt other users’ learning experience
We reserve the right to suspend or terminate accounts that violate these terms.
6. Account Termination
Xcel Learning may suspend or terminate accounts that:
- Violate these Terms
- Engage in abusive or fraudulent behavior
- Misuse course content
Users may request account deletion at any time by contacting us.
7. Limitation of Liability
Xcel Learning provides educational content “as is.” While we aim for accuracy and quality, we do not guarantee specific academic outcomes or exam results.
We are not liable for:
- Technical interruptions
- Data loss beyond reasonable control
- Third-party service issues
8. Third-Party Services
Our platform may link to or rely on third-party services (e.g., our payment provider Paddle, video hosting). We are not responsible for their content or practices.
9. Changes to Terms
We may update these Terms and Conditions at any time. Continued use of the platform indicates acceptance of updated terms.
10. Governing Law
These Terms are governed by the laws of Guyana.
